Not guilty plea in rundown case (Printed dec. 18, 2009)

The Scarborough man accused of running over a Portland man with his vehicle has pleaded not guilty to murder.
Timothy Antone, 42, of Willowdale Road, appeared Tuesday in Cumberland County Superior Court in Portland to enter his plea before Justice Joyce Wheeler.
Antone was indicted on one count of murder last Friday by a Cumberland County grand jury. He is accused of running over Roland Villacci in front of Villacci’s Auburn Street apartment building on Oct. 28. Villacci died of his injuries on Nov. 1.
Joel Vincent, Antone’s attorney, said he expects a bail hearing for his client in January. A bail hearing for Antone had been scheduled for Dec. 4 but was postponed.
Vincent said he is awaiting case materials from Maine Assistant Attorney General Lisa Marchese. If the materials, called discovery evidence, arrive soon enough, Vincent said he will seek a bail hearing later this month.
Vincent declined to comment on how is client was faring in jail.
Antone initially appeared in court Oct. 30, when his bail was reduced from $1 million to $100,000. The court revoked Antone’s bail on Nov. 3 after Villacci died.
Marchese said Antone killed Villacci after his ex-wife told him she had been sexually assaulted by Villacci. On the day Villacci was run over, Antone said he was going to kill him, according to Marchese.
Antone ran over Villacci as the victim ran from the Ford Explorer he was driving, according to Capt. Ted Ross of the Portland Police Department. He said Villacci had been warned by phone that Antone was waiting for him outside. The sport utility vehicle Antone was driving then struck a wall of the apartment building. Antone was arrested as he left the scene on foot, Ross said.
Although Antone and Elizabeth Antone are divorced, the couple continued to live together, said Antone’s mother, Janice Pinkham.
