Summer fight mars athlete’s prospects

A summer confrontation in Old Orchard Beach will lead to an autumn arraignment for a man who once lived in Scarborough.
Kyle Lewis, 23, must appear before Justice Paul Fritzsche in York County Superior Court in Alfred Nov. 6 to enter a plea on a charge of robbery with physical force, a Class A felony.
The charge stems from an incident occurring at about 1 a.m. on July 7, where Lewis allegedly punched and kicked a 17-year-old man from Salem, N.H.
According to Old Orchard Beach Deputy Police Chief Keith Babin, an officer driving by the intersection and of East Grand Avenue saw a disturbance. When he drove closer, he saw said he saw Lewis kick the victim in the head.
Lewis then fled on foot and was arrested after a brief chase. The victim sustained minor injuries and was not hospitalized, Babin said.
Accounts leading to the incident differ, Babin said. The victim, who was with a companion who declined to give a written statement, told police Lewis and two others approached him on the street.
The victim said Lewis asked him for change for a $20 bill before taking his wallet and punching him, according to Babin.
Babin said Lewis told police the confrontation began in a nightclub before it spilled out into the street.
Amy McGarry, who represents Lewis, said he had arrived in Scarborough last summer and was planning to attend St. Joseph’s College in Standish on a basketball scholarship.
Court records in Alfred show a motion filed in August asked to modify the initial bail conditions of $10,000 so that would Lewis be allowed to live with his family in Rochester, N.Y.
The motion said the basketball scholarship had been revoked and Lewis, who had been living at 28 Londmeadow Road, lost his job installing carpets.
Lewis was indicted by a York County grand jury earlier this month and was scheduled to appear in court Friday morning.
McGarry told Fritzsche her client had not been informed of the hearing in time to appear but that he had been “diligent” in meeting his bail conditions and staying in touch with her.
McGarry declined to comment on Lewis or the case against him, except to say “we have a very different story to tell.”
Lewis faces a maximum 30-year prison sentence if convicted.
